Four guilty of £5m pirate CD conspiracy



- Illegally imported pirate CDs from Czech Republic sold at market stalls and record stores across London and South East



- Guilty verdict for ringleaders to send a deterrent to CD pirate traders



Four pirate CD traders were today convicted for running a £5 million illegal operation that imported copyright-infringing CDs from the Czech Republic and sold them in shops and stalls across South East England. 



The record industry's UK and international organisations, BPI and IFPI, welcomed the outcome today at Snaresbrook Crown Court, which found all four defendants guilty of conspiring to defraud the music industry.



The case was brought by the Fraud Prosecution Service acting on information from the BPI and IFPI.  In January 2008, two of the defendants (Wasim Mir and Ayaz Qureshi) pleaded guilty to conspiring to defraud the music industry.  Today, the jury at Snaresbrook found the remaining two defendants (Farhat Nissa and Mohammed Shaikh) guilty as charged.



Nissa and Shaikh were found guilty after an eight-week trial. The court heard that Nissa's company, SFH, one of the largest independent brokers, based in Hatfield, Hertfordshire, was commissioned by Wasim Mir, a market trader, and others to import the CDs.  Mir admitted supplying market stalls and shops throughout the South East.



The operation involved the manufacture and distribution of unlicensed pirate urban music compilations. Some of these became brands in their own right with the "In The Club" series running for more than 15 editions. 



BPI made a test purchase of a CD which was dispatched to IFPI's Forensic facility.  Using state-of-the-art forensics, investigators were able to pinpoint the source of the discs and trace them back to a manufacturing plant in the Czech Republic, whose operators helped identify the convicted four UK traders. Waseem Mir was arrested and his storage facilities raided by the police.  During that raid 25,000 infringing discs were recovered and again samples were sent off for forensic examination by IFPI. 



BPI estimates suggest that more than 400,000 boxsets containing between two and five CDs, some with DVDs, which sold for around £12 a title, were imported during the fraud. The conspirators now face an application for their assets under the Proceeds of Crime Act.



BPI Director of Anti-Piracy David Wood, who ran the UK investigation said:

"These types of counterfeits can fetch significant sums, but none of those involved in creating the music received a penny for their work. It is simply not acceptable for people to line their pockets at the expense of the music community and the creative endeavours of others should be respected and paid for. We're delighted the FPS chose to take on this case and hope that this successful outcome will serve as a deterrent to others.  Brokers have a responsibility to ensure that they only deal in legitimate product and that they take precautions to ensure that they do so."



IFPI's Head of Enforcement, Len Hynds, said: "This was a sophisticated criminal conspiracy of international proportions.  The pirate's business model netted them vast profits dispelling the myth that music piracy is about street level rogue traders - the truth is that it's highly organised with far reaching societal impact.  Essentially this case was cracked through cooperation between the industry bodies and law enforcement in the UK and Czech Republic.  Of course none of this would have been possible without the efforts of the Metropolitan Police and I applaud its foresight and efforts pursuing this case.  Experience tells us that organised crime will turn its hand to whatever makes a profit - if it thought that music piracy was a soft option it should think again."

I'm not chasing yo to try and get work though,m i just wanted to make people aware as i know a few people on here use SFH..

Slandering other companies is not particularly professional and does the industry in which we serve no favours.

You may have read a press release from the BPI anti-piracy unit in respect to the conviction of pirates in Snaresbrook Crown Court. The press release refers to directors of SFH.

We strongly condemn CD piracy and until the full appeal of the matter has been heard, we think it is disingenuous of the BPI to continue to assert the allegations as being reliable.

The allegations made are in respect to less than a fraction of 1% of SFH UK business.

What the BPI failed to say in their press announcement was that the case has been appealed and in the coming weeks we expect to fully rebut the false claims made by the BPI.

During the case it was apparent that a number of Independent record companies supported SFH whilst a number of major record companies supported BPI. Indeed two former directors of BPI gave their support by giving defence evidence.

A fuller statement will be made later but SFH will continue to fight to clear our name and continues as the UK’s largest Independent CD brokerage.

I'm pretty sure they're still open for business, they were really good for the EDS 7"'s, answered all of our (often very stupid) emails within minutes and even let us change our labels about ten minutes before they were going to press them!

So they went into administartion not so long ago, so where is Kerem working now? I bet you knew what was coming but was still taking people's money?
have they set up a new operation yet? seems a new GZ broker has suddenly appeared called Mobinecko with a registered office in London, not a physical office though?

ooooh I got my post linked to the front page!

I currently have an ulcer coming on as a result of all this... looks like we're going with A1 for the album pressing as they reckon they can get it done in time for tour. Key said they could do the same, but they're a bit pricey.

Will let you know how it goes with A1.
